Arbitration

Arbitration, the best known means of dispute resolution, is provided by GlobalMedArb (GMA) through a unique split-screen video conferencing utilizing a computer-linked video camera. As a result, scheduling difficulties are alleviated and costs of travel, food, and lodging eliminated. Arbitration over the Internet tends to be far less expensive, moreexpeditious, and more informal than standard ADR proceedings.

The Arbitrator or Arbitrators (who appear on the computer screen together with the attorneys and witnesses) serve as the determiners of law and fact in place of a court of law. Where the service of a single Arbitrator is utilized to conduct the proceeding, he or she is selected upon the concurrence of all of the parties or their attorneys. In multi or tripartite Arbitration, the disputants choose an equal number of party appointed Arbitrators, who in turn select the Chairperson of the panel.

Sometimes called private adjudication, Arbitration is usually preferred in an international setting, where neither party desires to appear before the courts of the country of the other. As a result of being conducted from the participant’s home venues through the Internet, utilization of local legal representation is generally more conducive to the needs of the parties than retention of expensive international counsel.

A reasoned opinion shall be delivered at the end of the hearing, together with a final ruling. Decisions are binding and enforceable within the more than 140 nations that have ratified what is known as the U.N. New York Convention. The single arbitrator or chairperson of a tripartite arbitration panel may not be a national of the same country of any of the parties.

In conclusion, Arbitration/GMA utilizes the Internet's latest technology to provide the most efficient arbitral experience.
